Most NYC cases are scheduled at the New York City Field Office in lower Manhattan. In 2026 USCIS processes most N-400 cases in 6–10 months from filing to oath ceremony. Biometrics are typically at one of the NYC ASCs.

Eligibility refresher

Most NYC permanent residents apply under one of two paths:

  • 5-year path: 5 years as LPR, 30+ months physical presence in the U.S., 3 months residence in the state of filing.
  • 3-year path: married to and living with a U.S. citizen for 3 continuous years, 18+ months physical presence.

For an N-400 in 2026:

When you should bring in an attorney

Hire an immigration attorney if any of these apply:

  • Prior arrest or criminal record (even if dismissed or sealed).
  • Failure to file taxes for any year you should have filed.
  • Selective Service violation for men 26–31 who lived in the U.S. between 18–25.
  • Long absences from the U.S. (close to 6 months continuously, or 30+ months total absence in the qualifying period).
  • Prior N-400 denial or N-336 appeal in process.
